HOOKS, et al., 15 Defendants. 16 17 Plaintiff is a state prisoner proceeding pro se and in forma pauperis with an action filed 18 pursuant to 42 U.S.C. § 1983. Plaintiff’s second amended complaint is before the court for 19 screening under 28 U.S.C. § 1915A(a). The court has conducted the required screening and finds 20 that plaintiff may proceed on a claim against defendant California Department of Corrections and 21 Rehabilitation arising under Title II of the Americans with Disabilities Act (ADA). 22 As for plaintiff’s claims against Warden Perry, plaintiff has not adequately alleged that 23 she had actual knowledge of plaintiff’s mobility problems which would be required to proceed on 24 a claim arising under the Eighth Amendment based upon conditions of confinement presenting a 25 substantial risk of serious physical harm.
