HONEA, et al., 15 Defendants. 16 17 Plaintiff, a former pretrial detainee and current state prisoner, proceeds pro se with a civil 18 rights complaint filed pursuant to 42 U.S.C. § 1983. Defendants have moved to dismiss. ECF 19 No. 37. For the reasons set forth below, this court recommends that defendants’ motion be 20 DENIED. 21 I. Procedural History 22 On October 31, 2019, plaintiff filed her first amended complaint (ECF No. 23), and upon 23 screening the complaint the undersigned recommended claims against defendant Honea be 24 dismissed without leave to amend (ECF No. 26). The District Judge adopted the findings and 25 recommendations in full, and service was found to be appropriate for defendants Moreland and 26 Spencer on plaintiff’s claims for unreasonable search, retaliation, conditions of confinement 27 within the Butte County Jail,…
