15 This matter is before the court on a motion to dismiss certain claims from plaintiff Dimitrios Kastis’ third amended complaint (“TAC”) brought on behalf of defendants Joe Alvarado, Matt Basgall, and the City of Clovis (“the City”) (collectively, “defendants”). (Doc. No. 40.) Pursuant to General Order No. 617 addressing the public health emergency posed by the COVID-19 outbreak, the motion was taken under submission for decision on the papers. (Doc.
