Introduction 18 Plaintiff Eric Richard Eleson is a state prisoner incarcerated in Mule Creek State Prison 19 (MCSP) under the authority of the California Department of Corrections and Rehabilitation 20 (CDCR). Plaintiff proceeds pro se with a civil rights complaint pursuant to 42 U.S.C. § 1983, and 21 an application to proceed in forma pauperis filed pursuant to 28 U.S.C. § 1915. This action is 22 referred to the undersigned United States Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) 23 and Local Rule 302(c). For the reasons that follow, the undersigned grants plaintiff’s request to 24 proceed in forma pauperis and recommends dismissal of the complaint without leave to amend. 25 II.
