Whitsitt (“Plaintiff”), proceeding pro se, brings this civil action 19 pursuant to 42 U.S.C. § 1983. The matter was referred to a United States Magistrate Judge 20 pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. 21 On September 22, 2020, the magistrate judge filed findings and recommendations herein 22 which were served on Plaintiff and which contained notice that any objections to the findings and 23 recommendations were to be filed within fourteen (14) days. (ECF No. 3.) The time for filing 24 objections has expired, and no objections to the findings and recommendations were filed. 25 Accordingly, the court presumes that any findings of fact are correct.
