13 M. TRUTH, et al., 14 Defendants. 15 16 Plaintiff is a state prisoner proceeding pro se with a civil rights action pursuant to 42 17 U.S.C. § 1983. Plaintiff claims defendants used excessive force against him in violation of his 18 Eighth Amendment rights. Presently before the court is plaintiff’s motion requesting the 19 appointment of counsel and injunctive relief. (ECF No. 8.) For the reasons set forth below, the 20 court will deny the request for counsel and recommend that his request for injunctive relief be 21 denied. 22 I. Motion to Appoint Counsel 23 In support of his motion to appoint counsel, plaintiff alleges that he is a mental health 24 patient at the EOP1 level of care and he has trouble understanding and thinking such that he is not 25 able to represent himself. (ECF No. 8 at 1.) 26
