This proceeding was referred to this court pursuant to 28 U.S.C. § 636(b)(1) and Local Rule 302. On December 1, 2020, plaintiff was ordered to pay the filing fee or submit an application to proceed in forma pauperis pursuant to 28 U.S.C. § 1915. On December 2, 2020, plaintiff’s application to proceed in forma pauperis was entered on the docket as filed on November 30, 2020, along with his amended complaint, filed as a matter of course. Fed. R. Civ. P. 15(a)(1). Therefore, the December 1, 2020 order is vacated. Plaintiff submitted a declaration that makes the showing required by 28 U.S.C. § 1915(a).
