V. THUNG, et al., Defendants. 16 I. Introduction Plaintiff is a state prisoner, proceeding without counsel. Plaintiff seeks relief pursuant to 42 U.S.C. § 1983, and is proceeding in forma pauperis. Defendant Thung’s motion for summary judgment is before the court. As discussed below, defendant’s motion should be granted. II. Plaintiff’s Allegations In his verified complaint, plaintiff alleges the following. On November 22, 2017, plaintiff was returning from physical therapy in an ADA transport van. When plaintiff rolled his wheelchair to the ramp to exit, defendant Thung pushed the button to lower plaintiff’s wheelchair.
