On November 1, 2018, the undersigned issued Findings and Recommendations recommending that Defendants’ motion for summary judgment for failure to exhaust the administrative remedies be denied, without prejudice. (ECF No. 39.) On April 4, 2019, the District Judge adopted the Findings and Recommendations. (ECF No. 46.) On April 23, 2019, the undersigned set an evidentiary hearing pursuant to Albino v. Baca, 747 F.3d 1162 (9th Cir. 2014) in order to resolve the factual dispute as to whether Plaintiff exhausted the administrative remedies. (ECF No. 47.)
