No. 37) Defendants. 16 This matter is before the court on defendant United States of America’s motion to dismiss plaintiffs’ Tenth Amendment claim as asserted in the first amended complaint. (Doc. No. 36.) Pursuant to General Order No. 617 addressing the public health emergency posed by the COVID- 19 pandemic, the motion was taken under submission on the papers. (Doc. No. 39.) For the reasons set forth below, the court will grant the pending motion.
