Presently before the court is the motion to dismiss plaintiff’s first amended complaint filed by defendant New Rez, LLC, D/B/A Shellpoint Mortgage Servicing. (ECF No. 15.) Defendant’s motion to dismiss came on regularly for hearing on March 24, 2021. Plaintiff appeared pro se at the hearing; attorney Johnathan Cahill appeared on behalf of defendant. For the reasons set forth below, it is recommended that defendant’s motion be granted and plaintiff’s complaint be dismissed without leave to amend. I.
