Pending before the undersigned are defendants’ motions to dismiss pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure and plaintiff’s request for leave to amend. (ECF No. 49.) For the reasons stated below, defendants’ motions to dismiss will be granted and plaintiff will be granted leave to file a third amended complaint. BACKGROUND Plaintiff, proceeding pro se, commenced this action on November 12, 2020, by filing a complaint and later paying the applicable filing fee. (ECF No. 1.)
