Defendants. DISMISS 15 I. FACTUAL ALLEGATIONS AND PROCEDURAL BACKGROUND1 On November 23, 2020, Gridley Police Officer Devin Pasley (“Pasley”) and another unidentified officer confronted Michael A. Libby (“Plaintiff”) outside his girlfriend’s residence in Gridley, California. Compl. ¶¶ 13-14, ECF No. 1. As Officer Pasley approached to arrest him, Plaintiff informed Pasley that he had “a physical disability caused by a previous shoulder surgery requiring the site of the injury to be treated with care.” Id. ¶¶ 16-17.
