18 This matter is before the court on the motion to dismiss filed by defendant County of Merced (“Merced County”) on July 29, 2020 (Doc. No. 18) and plaintiff’s motion for relief from the presentation requirements of California Government Code § 945.4 filed on December 14, 2020 (Doc. No. 33). Pursuant to General Order No. 617 addressing the public health emergency posed by the COVID-19 pandemic, the two pending motions were taken under submission on the papers. (Doc. Nos. 22, 34.)
