Plaintiffs seek class certification pursuant to Rule 23 of the Federal Rules of Civil Procedure. (Doc. 66.) On June 30, 2021, Defendants filed its opposition to the motion. (Doc. 70.) Plaintiffs filed a reply on July 30, 2021. (Doc. 71). In its opposition, Defendants contend that Plaintiffs lack standing under Article III to represent and certify a class pursuant to Rule 23(b)(2), citing evidence that Plaintiffs were employed with Defendants in 2017, 2018, and 2019, but they both quit in the middle of the 2019 harvest season, before this action was filed.
