Plaintiff filed a response in opposition on March 9, 2020 and Defendants filed a reply on March 16, 2020. (Doc. Nos. 30, 31). For the reasons set forth below, the undersigned recommends that the Court grant Defendants’ motion to dismiss and dismiss this action with prejudice.3 I. BACKGROUND A. Procedural History Plaintiff Larry Williams Cortinas, a state prisoner, is proceeding on his first amended complaint filed pursuant to 42 U.S.C. § 1983. (Doc. No. 17).
