On July 14, 2021, this action was reassigned to the undersigned pursuant to the parties’ consent to Magistrate Judge jurisdiction under 28 U.S.C. § 636(c)(1). (ECF No. 10.) Pending before the court is defendant’s motion to dismiss submitted on August 2, 2021. (ECF No. 14.) For the reasons stated below, defendant’s motion to dismiss is granted and plaintiff’s complaint is dismissed without prejudice. BACKGROUND Plaintiff, proceeding pro se, commenced this action on April 7, 2021, by filing a complaint and paying the required filing fee. (ECF No. 1.)
