Trial Court Opinion
IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF CALIFORNIA 10 ETUATE SEKONA, No. 2:17-CV-02479-JAM-DMC-P Plaintiff, v. FINDINGS AND RECOMMENDATIONS E. HOROWITZ, Defendant. 16 Plaintiff, a prisoner proceeding pro se, brings this civil rights action pursuant to 42 U.S.C. § 1983. Pending before the Court is Defendant’s motion for summary judgment, ECF No. 38, Plaintiff’s opposition, ECF No. 40, and Defendant’s reply, ECF No. 41. Defendant argues that Plaintiff’s claim of deliberate indifference is barred by res judicata, and that there is no genuine dispute about whether Defendant was deliberately indifferent to Plaintiff’s serious medical needs. ECF No. 38 at 4-8. In addition, Defendant contends that she is entitled to qualified immunity. Id. at 12-14. The undersigned agrees that there is no genuine dispute about whether Defendant was deliberately indifferent and thus recommends that Defendant’s motion for summary judgment be granted. / / / / / / / / / …
