Pending before the undersigned is defendant’s motion to dismiss pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure and plaintiff’s motion for the appointment of counsel. (ECF Nos. 15 & 20.) For the reasons stated below, plaintiff is granted leave to file an amended complaint, defendant’s motion to dismiss is denied without prejudice to renewal, and plaintiff’s motion for the appointment of counsel is denied.
