Defendant. 16 On September 28, 2021, plaintiff filed a complaint in California state court which defendant removed to this court on October 19, 2021.1 (ECF No. 1.) On October 21, 2021, defendant filed a motion to dismiss and set the hearing to take place on December 9, 2021. (ECF No. 8.) By minute order, the hearing was reset to take place on December 8, 2021. (ECF No. 5.) Plaintiff did not file a response to defendants’ motion to dismiss. On December 2, 2021, the court vacated the scheduled hearing and ordered plaintiff to show cause, in writing and within 14 days, why the failure to oppose the motion to dismiss should not waive the right to oppose the motion and why this action should not be dismissed.
