18 Plaintiff Rodolfo Martinez (“Plaintiff”) is a state prisoner proceeding pro se and in forma 19 pauperis in this civil rights action pursuant to 42 U.S.C. § 1983. Plaintiff’s complaint, filed on 20 September 1, 2021, was screened and Plaintiff was granted leave to amend. Plaintiff’s first 21 amended complaint, filed on October 18, 2021 is before the Court for screening. (Doc. 10.)
