INTRODUCTION 20 On July 29, 2019, Plaintiff DuJuan Mauricio Fernandez (“Plaintiff”), an 21 inmate at California Substance Abuse and Treatment Facility and Prison, proceeding 22 pro se, filed a Complaint alleging violations of his civil rights pursuant to 42 U.S.C. 23 § 1983 (“Section 1983”). (Compl., ECF No. 1.) On November 15, 2019, the Court 24 screened and dismissed the Complaint with leave to file an amended Complaint. 25 (Order Dismiss Compl., ECF No. 8.) Plaintiff filed a First Amended Complaint on 26 December 10, 2019. (“FAC,” ECF No. 9.) 27 The Court has screened the FAC as prescribed by 28 U.S.C. § 1915A and 28 28 U.S.C. § 1915(e)(2)(B).
