17 18 I. INTRODUCTION AND BACKGROUND 19 Plaintiff Rusty Rendon initiated this action against Defendant Bracketron, Inc. 20 in the Superior Court for the State of California, County of Los Angeles. (See Notice 21 of Removal (“Removal”) ¶ 1, ECF No. 1.) Rendon asserts a single cause of action for 22 violation of the California Unruh Civil Rights Act (“Unruh”), Cal. Civ. Code § 51 et 23 seq. (Removal Ex. A (“Compl.”) ¶¶ 21–28, ECF No. 1-1.) On October 16, 2019, 24 Bracketron removed the action to this Court on the basis of federal question 25 jurisdiction pursuant to 28 U.S.C. § 1331. Bracketron argues that Rendon’s Unruh 26 claim raises a federal question because it is predicated on a violation of the Americans 27 with Disabilities Act (“ADA”), 42 U.S.C. § 12182 et seq.
