INTRODUCTION 20 This matter comes before the Court on Plaintiff’s Motion to Remand Action to 21 State Court (ECF No. 14), and Defendants’ Motion to Dismiss Under Rules 12(b)(1) 22 and 12(b)(6) (ECF No. 16). For the following reasons, the Court GRANTS Plaintiff’s 23 Motion and DENIES AS MOOT Defendants’ Motion.1 24 II.
