Saul2, 3 Commissioner of Social Security’s (hereinafter “Commissioner” or “Defendant”) denial 4 of his application for a period of disability and disability insurance benefits (“DIB”). 5 Plaintiff contends that the Administrative Law Judge (“ALJ”) improperly rejected his
6 allegations of daytime somnolence in assessing his residual functional capacity. For the 7 reasons stated below, the decision of the Commissioner is affirmed, and this matter is 8 dismissed with prejudice.3 9 II.
