The cover page of the Petition cites to both 28 U.S.C. § 2254, 22 the habeas statute applicable to state prisoners seeking to challenge a state court judgment, and 23 42 U.S.C. § 1983, the statute that applies to civil rights actions against state actors. (ECF No. 1 24 at 1). Petitioner states that he has been charged with carjacking (Cal. Penal Code § 215(a)), and 25 26 27 28 1 being a felon in possession of a firearm (Cal.
