INTRODUCTION Plaintiff Anthony Moreno (“Moreno”), an inmate proceeding pro se and in forma pauperis, filed a Complaint pursuant to 42 U.S.C. § 1983 (“Section 1983”) alleging violations of his Eighth and Fourteenth Amendment rights as well as a state law claim for intentional infliction of emotional distress. For the reasons discussed below, the Court dismisses the Complaint with leave to amend. /// /// /// /// II.
