I. INTRODUCTION
Before the Court is the motion to dismiss filed by defendant Quibi Holdings, LLC (“Quibi’”) and defendant Jeffrey Katzenberg (“Katzenberg’’) and the motion to stay patent claims pending inter partes review by the patent office filed by Quibi. The procedural and factual background of this dispute is set out in the Court’s July 28, 2020 Order. See generally Case No. 2299 ("Eko ECE") Nos. 201 — 201-2 (redacted); Eko ECF Nos. 202 — 202- (sealed) (the “MTD Order”). Accordingly, the Court recites only those facts necessary to resolve the parties’ present motions.
