Frisby (“Plaintiff”), a California state 21 inmate proceeding pro se, filed a Complaint alleging violations of his civil rights 22 pursuant to 42 U.S.C. § 1983. (ECF No. 1.) On August 5, 2019, the Court granted 23 Plaintiff’s amended Request to Proceed Without Prepayment of Filing Fees with 24 Declaration of Support. (ECF Nos. 5–6.) On August 7, 2019, pursuant to the 25 Congressionally-mandated screening of any case in which a prisoner seeks redress 26 from a governmental entity or officer or employee of a governmental entity, or in 27 which a plaintiff proceeds in forma pauperis, the Court issued an Order dismissing 28 the Complaint with leave to amend.
