18 Pursuant to 28 U.S.C. § 636, the Court has reviewed the First Amended 19 Petition, the records on file, and the Report and Recommendation of United 20 States Magistrate Judge. No objections to the Report and Recommendation 21 have been filed. The Court accepts the Magistrate Judge’s Report and adopts 22 it as its own findings and conclusions. 23 Further, the Court finds that Petitioner has not made a substantial 24 showing of the denial of a constitutional right or that the court erred in its 25 procedural ruling and, therefore, a certificate of appealability will not issue in 26 this action.
