(“Motiv”) initiated this putative class action against 19 Defendant Continental Casualty Company (“Continental”) seeking declaratory 20 judgment for insurance coverage. (Compl., ECF No. 1.) Continental moves to dismiss, 21 (Mot. to Dismiss (“Motion” or “Mot.”), ECF No. 51), and non-party United 22 Policyholders (“UP”) moves for leave to file an amicus brief in opposition (“UP 23 Motion”), (UP Mot., ECF No. 60).
