On February 23, 2021, the Court issued an Order dismissing the First Amended Petition in this action with leave to amend and directed Petitioner to file either a Second Amended Petition for Writ of Habeas Corpus by a Person in State Custody, pursuant to 28 U.S.C. § 2254 (“Second Amended Petition”), no later than March 25, 2021 if he still wished to pursue this action. (Dkt. No. 8). Plaintiff was also advised that if he wished to file a civil rights action pursuant to 42 U.S.C. § 1983, he should file a voluntary dismissal of this action and then proceed to file a Civil Rights Complaint, pursuant to 42 U.S.C. § 1983, on the proper Central District form.
