Background Defendant timely removed this action from the Los Angeles Superior Court (“LASC”) on February 24, 2021. Dkt. 1. The Complaint alleges Plaintiff is a California corporation with its principal place of business in the County of Los Angeles, and Defendant is a Delaware corporation with its principal place of business in Massachusetts. Dkt. 1-1 (“Compl.”) Ff 1-2. In its Notice of Removal, Defendant alleges the court has subject matter jurisdiction pursuant to 28 U.S.C. § 1332(a) because the amount in controversy exceeds $75,000 and complete diversity exists between the parties. Dkt. 1 at 1-2. Discover Bank asserts, however, that it is a Delaware state-chartered bank with its principal place of business in the state of Delaware, rather than Massachusetts. /d. at 2.
