16 17 I. INTRODUCTION 18 Plaintiff Felixberto Legaspi moves for leave to file a First Amended Complaint 19 (“FAC”) to add a new cause of action and additional factual allegations. (Mot. to 20 Amend Compl. (“Mot.”), ECF No. 32.) The motion is fully briefed. (Opp’n, ECF 21 No. 34; Reply, ECF No. 38.) For the following reasons, the Court DENIES Legaspi’s 22 Motion.1 23 II. BACKGROUND 24 Legaspi claims that while he was in the Philippines “[s]ometime in early 25 2017, . . . an imposter willfully obtained [his] personal identifying information and 26 used such information to fraudulently open a line of credit with Citibank, N.A.” 27
