I. BACKGROUND

On March 26, 2021, Plaintiff The People of the State of California filed a complaint against Defendant Credit One Bank, N.A. in the Superior Court of California for the County of Riverside. (“Complaint,” Dkt. No. 1-1.) The Complaint asserts one cause of action for unfair competition under Bus. & Prof. Code § 17200 for violation of the Rosenthal Act and California Right to Privacy. (Compl.) On May 19, 2021, Defendant removed the action to federal court, arguing that this Court has ori ginal jurisdiction over the action because it is completely preempted by the National Bank Act, 12 U.S.C. § 484, and its corresponding regulations, 12 C.F.R. § 7.4000.
