I. BACKGROUND AND SUMMARY

19 On April 26, 2019, plaintiff Jane M. Murray, who is at liberty, is proceeding 20 pro se and has been granted leave to proceed in forma pauperis, filed a Civil Rights 21 Complaint (“Original Complaint” or “OC”) pursuant to 42 U.S.C. § 1983 against 22 the City of Fountain Valley (the “City”), Fountain Valley Police Department 23 (“FVPD”) Chief Kevin Childes in his official capacity, and FVPD Officer Mike 24 Parsons in both his individual and official capacities. (Docket No. 1). Plaintiff’s 25 Original Complaint set forth five causes of action and sought compensatory and 26 punitive damages.
