On June 1, 2021, Plaintiff filed the operative First 20 Amended Complaint (“FAC”), which Defendant now moves to dismiss pursuant to 21 Federal Rule of Civil Procedure (“Rule”) 12(b)(1) and 12(b)(6). (FAC, ECF No. 17; 22 Mot. Dismiss (“Mot.”), ECF No. 18.) For the reasons that follow, the Court GRANTS 23 the Motion and dismisses the action. II.
