Pending before the undersigned are plaintiff’s motions to dismiss defendants’ counterclaim pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure and for an order requiring defendants to file an amended answer. (ECF Nos. 37 & 38.)
