Having reviewed the supplemental briefing filed by the parties, the undersigned will vacate the findings and recommendations filed on August 23, 2021. In the amended findings and recommendations that follow, the undersigned recommends the court grant in part and deny in part the defendants’ motion for summary judgment. I.
