Pending before the undersigned is defendants’ motion to dismiss the amended complaint pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure. (ECF No. 31.) For the reasons stated below, defendants’ motion to dismiss is granted and plaintiff is granted leave to file a second amended complaint.
