16 17 Plaintiff Preston Taylor is proceeding in forma pauperis in this civil rights action filed 18 pursuant to 42 U.S.C. § 1983. 19 Currently before the Court is Defendant Burden’s motion for summary judgment, filed 20 July 22, 2022. 21 I. 22 BACKGROUND 23 This action is proceeding against Defendant Turner for excessive force and against 24 Defendant Burden for deliberate indifference to a serious medical need. 25 On December 14, 2020, Defendant Turner filed an answer to the complaint.
