Pending before the undersigned are defendants’ amended motion to dismiss pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure, as well as plaintiff’s request for “ruling to be placed on hold,” and to appear telephonically at a hearing. For the reasons stated below, defendants’ motion to dismiss is granted, plaintiff is granted leave to file an amended complaint, and plaintiff’s motions are denied as having been rendered moot.
