S. BURCIAGA, Defendant. 16 Plaintiff is a state prisoner proceeding pro se with a civil rights action pursuant to 42 U.S.C. § 1983. Currently before the court is defendant’s motion for summary judgment. ECF No. 93. I. Procedural History Plaintiff initiated this action by filing a letter in the United States District Court for the Northern District of California. ECF No. 1. After being directed to file a complaint (ECF No. 4), plaintiff filed an original complaint (ECF No. 12) which was dismissed with leave to amend (ECF No. 16). Plaintiff then filed an amended complaint (ECF No 18), which was transferred to this court (ECF No. 22).
