16 17 Plaintiff McKinley Pierce Atkins is proceeding pro se and in forma pauperis in this civil 18 rights action brought pursuant to 42 U.S.C. § 1983. 19 I. RELEVANT PROCEDURAL BACKGROUND 20 On September 15, 2022, the previously assigned magistrate judge issued Findings and 21 Recommendations to Grant Defendants’ Motion for Summary Judgment for Plaintiff’s Failure to 22 Exhaust Administrative Remedies. (Doc. 52.) 23 On October 5, 2022, the Court issued an order granting Plaintiff an extension of time 24 within which to file objections to the Findings and Recommendations. (Doc. 54.)
