17 18 The matter is before the court on a motion to dismiss plaintiff’s second amended 19 complaint filed on behalf of defendants LTF Club Management Co., LLC and Life Time Fitness, 20 Inc. on May 9, 2022. (Doc. No. 33). The matter was taken under submission on the papers by 21 the previously assigned district judge. (Doc. No. 37.) On August 25, 2022, this case was 22 reassigned to the undersigned. (Doc. No. 38.) For the reasons set forth below, defendants’ 23 motion to dismiss will be granted in part and denied in part. 24 BACKGROUND 25 This court has twice dismissed plaintiff Samuel Turner’s putative class action complaint 26 alleging various wage-and-hours violations under Federal Rule of Civil…
