17 18 Petitioner is a state prisoner proceeding pro se and in forma pauperis with a petition for writ of 19 habeas corpus pursuant to 28 U.S.C. § 2254. 20 Petitioner filed his petition in this Court on June 2, 2022.2 (Doc. 1.) On September 30, 2022, 21 Respondent filed a motion to dismiss contending that the petition violates the statute of limitations. 22 (Doc. 13.) Petitioner did not file an opposition to the motion to dismiss. Upon review of the 23 pleadings, the Court finds that the petition violates the statute of limitations.
