15 Defendants. 16 17 Plaintiff Israel Rios, a prisoner, initiated this action proceeding in forma pauperis by filing 18 a pro se civil rights complaint filed under 42 U.S.C. § 1983. On September 30, 2022, Plaintiff, 19 assisted by counsel, filed a third amended complaint. (Doc. No. 36, “TAC”). Plaintiff’s TAC is 20 subject to screening under 28 U.S.C. § 1915A. For the reasons set forth below, the Court finds 21 the TAC states cognizable claims and will direct service of process by separate order. 22 I. BACKGROUND 23 A.
