(ECF No. 16) 16 17 Plaintiff Lyralisa Lavena Smith is proceeding pro se and in forma pauperis in this civil 18 rights action filed pursuant to 42 U.S.C. § 1983. This matter was referred to a United States 19 Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. 20 On September 16, 2022, the Magistrate Judge screened Plaintiff’s first amended complaint 21 and issued findings and recommendations suggesting that this action be dismissed for failure to 22 state a claim upon which relief may be granted. (ECF No. 16.) On September 28, 2022, Plaintiff 23 timely filed objections to the findings and recommendations.
