Plaintiff accompanies his motion with a 20 proposed [second] amended complaint. (Doc. No. 135). Defendants oppose the motion. (Doc. 21 No. 137). For the reasons stated below, the undersigned recommends that Plaintiff’s motion for 22 leave to file a second amended complaint be denied. 23 BACKGROUND AND PROCEDURAL HISTORY 24 A.
