Introduction 20 Plaintiff Maria Teresa Hernandez (“Plaintiff”) seeks judicial review of a final decision of 21 the Commissioner of Social Security (“Commissioner” or “Defendant”) denying her application 22 for supplemental security income pursuant to Title XVI of the Social Security Act. The matter is 23 before the Court on the parties’ briefs which were submitted without oral argument to the United 24 States Magistrate Judge.1 Docs. 15, 22. After reviewing the record the Court finds that substantial 25 evidence and applicable law do not support the ALJ’s decision. Plaintiff’s appeal is therefore 26 granted. 27
